The first step to retrieve your hard earned money, is to obtain a judgment against the debtor.

This is achieved by issuing and serving summons, and then applying to court for default judgment. Once you have your judgment, you can proceed with execution.
 

Execution is the process whereby the sheriff attaches and sells the debtors assets to retrieve your money due, if the debtor has no assets, we can attach his salary, or get an order for a monthly instalment payment.

It is important to know that under South African law, debts prescribe after 3 years, so if you do not sue somebody after 3 years from the date the debt became due, you will lose your legal claim.
